The proceedings have been both protracted and vexatious and have been brought to the present issue solely by Mr Saint's determination to have the case decided.
The Defendants' counsel (Mr Chisholm Anstey) has advised us that it is of importance to the Defendant that Counsel should be heard on the Attorney's petition for leave to appeal to the Privy Council. Our object in addressing your Lordship is to ask that the Solicitor to the Treasury should be instructed to give no notice of any such application on the part of the Attorney General at Hong Kong that counsel be enabled to appear in the first instance on behalf of the Respondent Mr Saint.
